Public school districts and non-profit schools, including charter schools and schools affiliated with religious institutions, must comply with the federal Asbestos Hazard Emergency Response Act (AHERA). AHERA sets forth a set of standards that must be met to identify, inspect, and properly manage materials on campuses that may contain asbestos. The purpose of AHERA is to prevent exposure to asbestos in children while at school.
In general, AHERA regulations require schools to:
- Perform an inspection of their school for asbestos-containing building material (ACBM)
- Prepare a management plan and take action to prevent or reduce asbestos hazards
- Meet additional specifications of re-inspections, training, and operations and maintenance.
- Comply with the Asbestos National Emissions Standards for Hazardous Air Pollutants (NESHAP) if it is necessary to remove any asbestos during renovation or if school buildings will be demolished
